Fix the Housing Crisis. Don’t Criminalise Poverty.
On 18 February, Parliament will vote on whether to continue or scrap a DA Bill that closes dangerous loopholes in South Africa’s land and housing laws.

Homelessness is not the problem
Government failure is.
For 30 years, the ANC has failed to deliver enough housing for indigent South Africans:
- Poorly built houses
- A housing backlog affecting over 13 million South Africans
- More money spent, but fewer homes built
The result is millions living in informal settlements or on the streets.
Criminal syndicates are exploiting the crisis
While homelessness is not illegal, criminal networks are:
- Inciting unlawful land occupations
- Illegally selling or renting land they do not own
- Profiting while communities are left without services
This costs taxpayers billions and delays housing for those who need it most.
What the DA’s Amendment Bill does
The Bill does not criminalise homelessness.
It targets criminal abuse of the system by:
- Criminalising the incitement of unlawful land occupation
- Giving courts better tools to assess eviction cases fairly
- Ensuring alternative accommodation is time-bound and realistic
